Judge Larry Seidlin became choked up and teary-eyed while issuing his decision today in the court dispute over where Anna Nicole Smith’s body should be buried and what should become of her daughter Dannielynn.

Anna Nicole’s mother, Virgie Arthur, and Smith’s ex-boyfriend Larry Birkhead and companion Howard K. Stern have spent the last three days embroiled in debate in a Fort Lauderdale, Florida, court room, and all three burst into tears upon hearing the ruling.

Judge Seidlin ultimately left the decision of Smith’s burial to attorney Richard Milstein, who is the appointed guardian of Smith’s 5-month-old daughter Dannielynn.

However, he told the court that he hopes the former Playboy Playmate will be buried in the Bahamas next to her son Daniel, who died last September.

"I want them to be together," the judge told the court.

Milstein, who specializes in guardianship, probate and mediation, will work with all three parties to determine the final resting place of Anna Nicole, on behalf of her next of kin survivor, Dannielynn.

Smith died two weeks ago at age 39 in a South Florida hospital after being found unconscious in her hotel room. The cause of death remains under investigation.
