Britney Spears' former bodyguard Tony Barretto is at it again. Usmagazine.com has learned via a statement released by Barretto's lawyer, Gloria Allred, that he has filed a "Child Abuse Referral" against his old employer.

The referral gives the Department of Child and Family Services the legal power to investigate Spears' care of sons Sean Preston, 2, and Jayden James, 1. According to Barretto and Allred, the DCFS has said that they will look into the matter.

"I call on Britney Spears to cooperate with the investigation of Children and Family Services," Allred said in her statement. "As part of their investigation they will want to interview her. Rather than avoiding them she should speak with them as soon as possible and give them the truth, the whole truth and nothing but the truth, so that they can fulfill their legal mandate to protect the children and keep them safe."

This is not the first referral that has been filed regarding Spears with the DCFS. She has been investigated and cleared three times in the past two years, for driving with Sean Preston in her lap, not preventing Sean from falling out of his high chair, and contributing to the poor dental hygiene and bad eating and sleeping habits of both of her sons.

Barretto was touted as a "mystery witness" by Gloria Allred before going public on September 17, when he filed a declaration to the court claiming Spears had used drugs and alcohol while caring for her children earlier this year.

Since then, Barretto has been on a media tour touting his concern for Spears' children as his motive for coming forward with information about the pop-mom's erratic behavior.
