Good for them for suing. It's a matter of principle right now. They know they already have a lot of money but the only way to really get companies attention anymore these days is not only bad publicity, which he is in a position to do quite well, but through their pockets/profits. What happened is atrocious. Here you have not just 1 but 2 new babies, which is suppose to be a time to celebrate and be happy, only to be stripped of that and living in fear that they will be taken from you because of a huge mistake on the behalf of many others. It's one thing to lose a child because of natural causes but to human error..it's a hard thing to accept and not want to deliver some consequences. Both parties are responsible for this (hospital and drug maker.) Thank God they could reverse the effects and this didnt end up being every parents fear--a dead child.

Dennis Quaid and wife Kimberly Buffington have filed a suit today against Chicago-based Baxter Healthcare Corp. for making the drug Heparin, which they claim seriously injured their newborn twins.
Quaid's attorney Susan E. Loggans told the Chicago Sun Times their babies, Zoe Grace and Thomas Boone, "were very critical for a while" after being given an accidental overdose of the drug at Cedars-Sinai Medical Center in Los Angeles last month.
She said the twins have recovered and "everything looks good."
Quaid is suing because he wants to prevent it from happening to any other children. Loggans said three children died in Indiana from a similar mix-up with the drug.
A Baxter Healthcare Corp. told Usmagazine.com: "We'll have to get back to you."

Both parties should be sued. I am an RN and work in the NICU and I occasionally fill in on other wards and both dosages are packaged in vials that do look very similar. The drug company should package it differently, because let's face it, if one is bright yellow and the other light blue, the risk of getting the wrong one decreases. However, if the protocols for drug administration were followed, this would have never happened. I don't know about other RNs, but I know it was drilled into my head the importance of making sure you give the correct dosage and the correct meds. It is one of my nightmares that I will do something like that, so it is one of the things I obsessively check. I know RNs are not taught to just grab a random vial and mindlessly give it to a patient. Unfortunately, when people get busy, rushed, or stressed, things tend to be glossed over and patient care can suffer. Part of it is the fault of the bean counters in hospital administration who have never been in patient care and cut vital staff, leaving the short amount of staff overburdened already. But it should always be, no matter what, patient care comes first. It only takes a few extra seconds to verify what you are giving a patient.
why aren't they suing the hospital instead??

This drug saved my life when the docs found that I have the Factor V Clotting Disorder. I am sure glad the company makes this drug. Geez, think about it! How the hell is their fault?

If possible look at the pictures of the labels of the bottles in questions, the dosage of 100 and the dosage of 10,000. THEN talk about the manufacturer's responsibility considering this type of overdose had happened on more than one occasion already.

This was a mistake on the part of many people, from the pharmacist tech who stocked the cabinet wrong to the nurse who gave the medicine, but does anyone think that it would have happened if the bottles had not looked so much alike?

If they are in fact sueing for only $50,000 that does indicate it is not the money they are after, but to see the company do something to prevent this from happening again. Common sense tells you to not have such different dosages in nearly identical bottles. I'd lay money that their goal is to see the labels change.
I would assume the amount comes from a legal requirement of some sort or is the estimated amount of their co-pays and any other losses.
And yes, people sue to get money quite often. However oftentimes it is to be reimbursed. Not to play gimmie.
By the way mistakes do happen it's unfortunate but heparin(blood thiner) and salin(regular fluids) are two complete different things. And you need heparin on a NICU unit ( Critical care unit for new borns) hello.
Yes the RN would need to be responsible but come on! They need to make the peds hot pink or something! Those bottles are too similar! They shouldn't even be using heprin in the nicu anyway, saline would have been fine.

If the nurse followed the 5 rights of medication administration this would have never happened. As a RN it is my worst nightmare to give meds incorrectly. To all current & future nurses, being a nurse has some awesome responsibilities. Please be mindful of this when you are on the job. Someone's life could depend on it.

after the mix up here in indiana with the same mistake happening...the drug company still did not change the labels. you would think that they might want to save their own ass...by making the two meds look completly different with labels and such. hopefully if he does win the lawsuit, he'll donate it. and hopefully this won't happen to anymore children regardless of who's they are.
